The companion piece to this article, “Situating Moral Justification,” challenges the idea that moral epistemology's mission is to establish a single, all‐purpose reasoning strategy for moral justification because no reasoning practice can be expected to deliver authoritative moral conclusions in all social contexts. The present article argues that rethinking the mission of moral epistemology requires rethinking its method as well. Philosophers cannot learn which reasoning practices are suitable to use in particular contexts exclusively by exploring logical relations among concepts. Instead, (...) in order to understand which reasoning practices are capable of justifying moral claims in different types of contexts, we need to study empirically the relationships between reasoning practices and the contexts in which they are used. The article proposes that philosophers investigate case studies of real‐world moral disputes in which people lack shared cultural assumptions and/or are unequal in social power. It motivates and explains the proposed case study method and illustrates the philosophical value of this method through a case study. (shrink)

We introduce the Relational Blockworld (RBW) as a paradigm for deflating the mysteries associated with quantum non-separability/non-locality and the measurement problem. We begin by describing how the relativity of simultaneity implies the blockworld, which has an explanatory potential subsuming both dynamical and relational explanations. It is then shown how the canonical commutation relations fundamental to non-relativistic quantum mechanics follow from the relativity of simultaneity. Therefore, quantum mechanics has at its disposal the full explanatory power of the blockworld. Quantum mechanics exploits (...) this expanded explanatory capability since event distributions among detectors per the density matrix follow from spacetime relations (symmetry group) alone. Thus, the event distributions of non-relativistic quantum mechanics follow from a blockworld wherein spacetime relations are fundamental. Per RBW "quantum mysteries" are deflated and the implications for consciousness and the perception of temporal flow and absolute becoming are explored. We conclude that given RBW, consciousness is no less fundamental than any "physical" feature of the world such as brain states. Further, active consciousness is needed to explain the illusion that it is a dynamical world and consciousness in its most fundamental state is relational and non-local. (shrink)

To many who develop and use free software, the GNU General Public License represents an embodiment of the meaning of free software. In this paper we examine the definition and meaning of free software in the context of three events surrounding the GNU General Public License. We use a case involving the GPU software project to establish the importance of Freedom 0 in the meaning of free software. We analyze version 3 of the GNU General Public License and conclude that (...) although a credible case can be made that the added restrictions are consistent with the definition of free software, the case requires subtle arguments. Strong arguments against the added restrictions are less subtle, and may therefore be more convincing to many users and developers. We also analyze the Affero General Public License and conclude that it is inconsistent with the definition of free software. (shrink)

The Epodes were published about 30 B.C. and, perhaps (...) for that reason, the scholiast Pseudo-Acron confidently assigns the poem to the period immediately before the battle of Actium with the comment: ‘Maecenatem prosequitur euntem ad bellum navale cum Augusto adversum Antonium et Cleopatram.’ It is curious that in referring to the activities of Octavian in 31 the author uses the title Augustus, which was not conferred on him before 27,: but the substance of his comment accords with the known facts. In the spring of 31 Octavian asked all Romans of influence to meet him at Brundisium, thereby to demonstrate their willingness to take part in the war against Antony and Cleopatra, and more than seven hundred senators are known to have offered their services. ABSTRACT Imagine Oskar Schindler before the bar of moral theory. Schindler, a minor industrialist, sheltered more than 1000 Jews during the Holocaust. This would seem to be a record of virtue. Or is it? The dominant consensus in moral theory stresses a rationality and universality of judgement and action that Oskar did not even consider. Efforts to interpret Schindler in universal terms by reference to human rights or to the tenet that ought implies can are entertained and denied. If Schindler's (...) deeds are moral reality, the consensus in contemporary moral theory is the poorer for being unable to recognise them. Schindler's virtue is noteworthy in its own right and also as a limiting case for the mainline of contemporary moral theory. (shrink)

During the decades following the publication of Darwin's Origin of species in 1859, religious belief in England and in particular the Church of England experienced some of the most intense criticism in its history. The early 1860s saw the appearance of Lyell's Evidence of the antiquity of man , Tylor's research on the early history of mankind , Renan's Vie de Jésus , Pius IX's encyclical, Quanta cura, and the accompanying Syllabus errarum, John Henry Newman's Apologia , and Swinburne's notorious (...) Atalanta in Calydon ; it was in this period also that Arthur Stanley was appointed Dean of Westminster, and that Bills were introduced in Parliament to amend or repeal the ‘Test Acts’ as they affected universities. They were the years that witnessed Lyell present the case for geology at the British Association at Bath , the first meeting of the X-Club , and the award of the Royal Society's Copley Medal to Charles Darwin. These were the years in which, as Owen Chadwick has put it, ‘the controversy between “science” and “religion” took fire’. (shrink)

This is the first full-length biography of John Langshaw Austin (1911–60). The opening four chapters outline his origins, childhood, schooling, and time as an undergraduate, while the next four examine his early career in professional philosophy, looking at the influence of Oxford Realism, Logical Positivism, Pragmatism, and the later Wittgenstein. The central twelve chapters then explore Austin’s wartime career in British Intelligence. The first three examine the contributions he made to the campaigns in North Africa; the next seven the seminal (...) role he played in ensuring the outstanding accuracy of the D-Day Intelligence; while the final two explore his contributions to Arnhem, the Ardennes, and the post-war administration of Germany. The last main section of the book then outlines and assesses Austin’s contributions to post-war Oxford Ordinary Language Philosophy. The first three chapters discuss the impact on Oxford philosophy of the cultural atmosphere of post-war Britain and the later Wittgenstein’s ideas. The next four look at Austin’s influence on post-war Oxford, particularly his Saturday morning discussion group and his perception lectures. The next five chapters concentrate on America’s influence on Austin and vice versa, paying particular attention to Austin’s work on speech-acts and his semesters in Harvard and Berkeley. This is the first of two companion articles drawn from a larger project, provisionally entitled Undisciplining Moral Epistemology. The overall goal is to understand how moral claims may be rationally justified in a world characterized by cultural diversity and social inequality. To show why a new approach to moral justification is needed, it is argued that several currently influential philosophical accounts of moral justification lend themselves to rationalizing the moral claims of those with more social power. The present article explains (...) how discourse ethics is flawed just in this way. The article begins by identifying several conditions of adequacy for assessing reasoning practices designed to achieve moral justification and shows that, when used in contexts of cultural diversity and social inequality, discourse ethics fails these conditions. It goes on to argue that the failure of discourse ethics is rooted in its reliance on a broader conception of moral epistemology that is invidiously idealized. It concludes by pointing to the need to rethink both the mission and the method of moral epistemology. (shrink)

The passing on of information to GPs by genito-urinary doctors is to be encouraged but is not always possible and ultimately the patient's wishes and confidentiality must be respected if sexually transmitted diseases and HIV infection are to be controlled. Infected health-care workers should seek counselling and medical support and clear guidelines from professional organisations which are in existence. However, they will only do so if strict confidentiality is maintained and assurance about future employment can be given.

In Fiction, Truth and Literature, Lamarque and Olsen argue that if a critic claims or attempts to prove that the outlook of a work of literature is true or false, he is not engaging in literary or aesthetic appreciation. This paper argues against this position by adducing cases where literary critics discuss the truth or falsity of a work’s view, when their opinions are obviously relevant to the work’s aesthetic assessment. The paper considers in detail the way factual errors damage (...) a work’s aesthetic standing, and shows that Lamarque and Olsen’s alternative account of the role of propositional truths in literature only looks plausible because it considers a restricted range of examples. Finally, it considers the role intention, date and genre play in discussions of the aesthetic damage done by literal falsehood. (shrink)
